Wayne’s off the Tower

bilde.jpgSeveral people have e-mailed us informing us that Wayne is down from the radio tower he climbed a week ago in protest of losing a lawsuit filed against him and his neighbours.

From the Montgomery, Alabama Advertiser:

Wetumpka man ends tower protest    

Wayne Spires made his descent from a 68-foot radio tower today to end his protest of a court ruling on an ongoing land dispute in a small community outside Wetumpka.

Spires, 61, chose 1 p.m. to complete a full week – to the hour – on the tower behind his Wallsboro home.

“I’m weak-legged,” Spires told the Advertiser, adding that he came down because friends had called the secretary of Circuit Court Judge John Bush and “she said he’s still doing some research (on the case).”

Spires and neighbors say they were wrongly sued for failing to participate in a homeowners group they wanted no part of.

Spires denied overnight storms played a factor in his decision to come down and said he would go back up the tower depending on the judge’s decision.

We wish Wayne and his family well, and will keep your advised of any further updates, and if Wayne remains earthbound. We all support you, Wayne! Keep fighting.

    Kudos to Wayne! You have to admire a guy who at 61 y/o would go to such extremes to protest such unfair treatment. This gentleman is one to be admired for his tenacity and he has proven he is truly Hamsexy! How many wussies half his age would do what he has done to stand up for his rights and to bring public attention to his unfair and unjust treatment. Is Wayne an OF? Hardly! Wayne is a hero!

    To be honest, the storms that came through the area yesterday would be good enough reason for me to come down. No shame in that!

    Wayne did right by standing up for his cause. Completely non-violent and exercising his free speech. Good luck on his cause…it could be any of us next.

    Wayne doesn’t deserve to be treated this way by the homeowners association.
    He was there long before them and they should not have any say about what he does on his property.
    After all, he is only exercising his right as an amateur, under federal law and it shoould supercede any local association.

    The directors of the River Falls Homeowners Association are asking people to follow the rules of the HOA, yet they themselves are breaking these very rules!!!

    Keep it clean

    Rule #20 states: “Each lot owner or Association shall keep the lot clean and free of debris, trash, limbs, leaves, garbage, weeds or undergrowth. Grass and shrubs are to be cut and trimmed on a regular basis so that the appearance of the premises shall be neat. No discarded furniture, equipment, appliances, vehicles, or similar objects shall be permitted within the private or common areas of the development.”

    Director #1 has trash and overgrowth in his lots:

    Motor vehicles

    Rule #17 states: “Disabled motor vehicles shall not be allowed on the premises.” It also states that they are to be removed with 30 days. And that “Pending the removal…the lot owner shall store the same out of sight of passersby, and not nearer than twenty (20) feet to any side”

    Director #1 has had a disabled tractor on one of his lots for almost a year. It is in clear view of passerbys and in the second picture you can see that it is closer than 20 feet to the road.

    Animals

    Rule #14 states: “No swine, poultry, goats, cattle or other animals except domestic animals (dogs, cats, etc.) shall be permitted on or around the premises. Lot owner may request of the Association the right to have a horse or horses on the premises. If said permission is granted, the Association will establish terms and conditions for the maintenance of said property and animal.”

    Director #2 has horses. The Association never established terms and conditions for having horses.

    (Anybody out there know the correct size for a horse pin? This one seems a little small.)

    Signs

    Rule #13 states: “No sign or other unsightly object shall be placed on any lot in this development except (a) one sign containing names and addresses of occupants, if so desired; (b) one sign of not more than three square feet advertising the lot for sale or rent”
